Federal Court of Appeal will not hear appeal of NEB ruling on Trans Mountain Expansion Project
The Federal Court of Appeal has dismissed a group’s application for leave to appeal the National Energy Board’s Ruling No. 34[Filing A63200] concerning the Trans Mountain Expansion Project. In its Ruling, the Board found that neither section 55.2 of theNational Energy Board Act nor the Board’s participation decisions in the Trans Mountain Expansion Project hearing violated the freedom of expression guarantee of the Canadian Charter of Rights and Freedoms. The Court did not provide reasons for its decision, which is its usual practice.
